Letcher magistrate candidate arrested

A candidate for magistrate in Letcher County was arrested over the weekend.

According to court documents, 61-year-old Emory “Fudge” Mullins, of Neon, was arrested on misdemeanor charges of third-degree criminal trespassing and harassment after he entered the property of Carty Funeral Home in Jenkins Saturday morning.

According to court documents, Mullins was under verbal and court orders to avoid the property, but delivered flowers to the funeral home on Saturday. An arrest citation said Mullins also committed the crime of harassment “when he made statements about” the property owner’s juvenile child.

Mullins was arrested shortly after the incident at his residence and was lodged in the Letcher County Jail. He was released on a $10,000 surety bond later Saturday.

Court documents said Mullins had been served a notice in February to avoid the property.

Mullins is seeking election as Letcher County’s District 3 magistrate. He won the Democratic primary for the position last month, and is set to face Republican and write-in challengers in November.

Mullins is due in Letcher District Court on his criminal charges June 13.
