LEXINGTON, Ky. — Fugitive former disability attorney Eric C. Conn and longtime friend and confidant Curtis Lee Wyatt have been named in a new indictment, alleging the two spent a year plotting Conn’s escape.

Both men are charged with conspiracy to escape and conspiracy to fail to appear. Conn is also charged with escape and failure to appear, while Wyatt is also charged with assisting or instigating escape, aiding and abetting failure to appear, and making false statements.

The two men were indicted Sept. 6, but the indictment remained sealed until today. Federal authorities often seal indictments until the defendants are in custody, but there is no indication in court records that either man has been arrested.

The indictment outlines a scheme to secure Conn’s escape from June 2016 to June 2 of this year, when Conn removed his GPS-equipped monitoring device and fled.

The plot allegedly included having Wyatt cross the Mexican border in several places, in order to test the security measures of various checkpoints. The men also allegedly opened a Mexican bank account with the assistance of an unindicted co-conspirator. They also allegedly set up a dummy corporation in Montana, with which they allegedly purchased a 2002 Dodge Ram, which Conn allegedly used to flee.

The indictment also alleges that Conn purchased an item known as a Faraday bag, which purportedly blocks wireless signals. It is in that bag that authorities found Conn’s monitoring device, discarded along I-75 in Lexington.
