Government ‘incredulous’ by Conn’s motion to dismiss

LEXINGTON, Ky. — As expected, the prosecutors have filed an objection to former disability attorney Eric C. Conn’s motion to dismiss some of the criminal charges he is currently facing.

Last month, Conn filed a motion to dismiss the original case against him. That case accuses Conn of various acts of conspiracy, fraud and other crimes as part of a scheme to defraud Social Security by obtaining disability benefits for clients with falsified medical evidence.

Conn later reached a plea deal in that case, agreeing to plead guilty to charges of theft and bribery, in exchange for the original case being dropped. However, Conn fled from house arrest a month before his sentencing. He was captured six months later in Honduras.

After his escape, prosecutors announced they would not drop the original case, because Conn had violated his plea agreement by fleeing.

Conn asked for the case to be dismissed, saying the government cannot pick and choose which parts of the plea agreement to enforce. Prosecutors say they are “incredulous” at Conn’s request and add the responsibility for the case continuing lies at his feet.

A judge will decide the matter at a later time.
