POUND, Va. — The Town of Pound dismissed its entire police force Tuesday night.
Now, a local prosecutor says the town has to address the safekeeping of criminal evidence.
During a public hearing and council meeting that stretched for more than six hours, including a one hour closed session, town council members voted to dismiss the chief and all police officers. No replacements have been hired.
But Commonwealth’s Attorney Chuck Slemp has filed a motion asking a judge to force the town to hire at least one officer to act as custodian of evidence for pending criminal cases. He says in the motion that Virginia law requires a departing chief to turn over records to a successor, and that evidence remain in custody of a law enforcement officer.
He says without a replacement to take custody of the evidence, there would be an illegal break in the chain of custody, and an obstruction of justice that could constitute a crime.
