Prosecutors ask for former sheriff to undergo psychiatric exam before murder trial

WHITESBURG, Ky. — After his attorney notified the court that he would be pursuing an insanity defense in his upcoming murder trial, prosecutors are requesting that former Letcher County Sheriff Shawn Mickey Stines undergo a psychiatric examination.

Stines, 44, of McRoberts, is charged with capital murder for the Sept. 19 shooting death of Letcher District Judge Kevin Mullins while the two men talked in the judge’s chambers.

The shooting was captured on security cameras, leaving no doubt as to who pulled the trigger. But last month, Stines’ attorney asked to present “expert evidence relating to a mental disease or defect or mental condition bearing on the issue of guilt and punishment.”

In a motion filed Monday, Kentucky Attorney General Russell Coleman asks the court for Stines to be transferred to the Kentucky Correctional Psychiatric Center so an examination can be performed for the prosecution. He notes that the prosecution has no objection for a defense expert to be present during that evaluation.

A judge will rule on the request at a later time.
