PRESTONSBURG, Ky. — A Prestonsburg woman facing a potential murder charge for shooting and killing her father is asking that she be allowed to share her side of the story to the grand jury considering her case.

Summer Adkins, 22, was arrested on a charge of murder after her father, 62-year-old Jimmy Harvey, was shot to death June 9.
Adkins’ attorney filed notice last Friday that she has requested to present evidence to the grand jury.
Kentucky’s Rules of Criminal Procedure allow defendants to request to present evidence during grand jury proceedings, but there is no guarantee they will be allowed to do so.
“If the defendant notifies the attorney for the Commonwealth in writing of his or her desire to present evidence before the grand jury, the attorney for the Commonwealth shall so inform the grand jury,” Rule 5.08 says. “The grand jurors may hear evidence for the defendant but are not required to do so.”
The request is the latest twist in a case that has seen support for Adkins from many who say her actions were justified. During her preliminary hearing, it was revealed that Adkins told police she shot her father because she had learned he was sexually abusing her niece. She further told police he had done the same to her as a child.
Following her arrest, she was released to home incarceration on an unsecured bond. Earlier this month, she was released from home incarceration, after her district criminal case was dismissed.
Commonwealth’s Attorney Brent Turner explained that the dismissal was a procedural matter based on the fact she had not been indicted within 60 days. Turner further said the grand jury continues to consider the case and has the ultimate authority as to whether Adkins will be tried for murder.
A motion hearing has been scheduled in the case for Sept. 4.
