Indicted Paintsville doctor found to have violated bond in handling of evidence

LONDON, Ky. — A Paintsville doctor is still awaiting a jury’s verdict in his trial on federal drug charges, but he has already been scolded for his loose handling of evidence in the case.

Dr. Loey Kousa is charged with five counts of unlawful drug distribution, two counts of health care fraud and two counts of lying in connection with health care benefits. The indictment accuses Dr. Kousa of writing prescriptions for opioids to patients who had no legitimate need for them, then have them return for medically unnecessary tests.

On Friday, the doctor was found to have violated his bond by allowing a witness to view documents used as evidence in the case.

During the witness’ testimony, it became apparent that she had reviewed the documents prior to the trial at Kousa’s direction. All evidence in the case is governed by a protective order barring it from being shared with anyone other than defense attorneys, their staffs, and Kousa himself.



During a bond violation hearing held without the jury present, Kousa stipulated to violating the protective order. U.S. District Judge Robert Wier found that Kousa violated his bond and likely engaged in witness tampering, but chose not to revoke his bond. However, he ordered that Kousa return any materials still in his possession and warned him not to contact any witnesses in the case outside the presence of counsel, and not to have any direct or indirect contact with any juror.

Trial resumed today with closing arguments to start the morning, after which the jury would receive its instructions and begin deliberating.
