Child porn suspect released to home incarceration

LAKE, W.Va. — A Logan County man facing federal charges of receiving, possessing and distributing child pornography has been released to home incarceration.

Prosecutors had argued that Marvin Wayne Akers, 39, should be kept in jail because he poses a danger to the public. But a judge rejected that request, after noting that officials waited three years to indict him after the alleged child pornography was discovered.

The judge also scheduled the case for trial on Nov. 16.
