Pike man indicted for hit-and-run that killed cyclist

PIKEVILLE, Ky. — A Pike County man accused of killing a cyclist while driving under the influence last year has been arrested again, after being indicted in the case.

Clinton Wayne Justice, 69, of Pikeville, is charged with vehicular homicide, DUI, tampering with physical evidence and leaving the scene of an accident.

The charges stem from an incident June 12, when Eric Deshaun Justice, 31, of Shelbiana, was struck by a vehicle and killed while he rode a bicycle along U.S. 460. The vehicle left the scene after the accident, but a witness was able to give police its license plate number, which led officers to Justice.

When officers spoke to him about an hour after the incident, they reported he was moving and speaking slowly, had drooping eyelids, and had difficulty understanding or following simple instructions.

Justice was arrested at that time and charged with vehicular homicide, DUI and leaving the scene of an accident. He was released from jail until September, after having not been indicted within 60 days.

A Pike County grand jury issued an indictment Feb. 13 and Justice was arrested on Tuesday. He is scheduled to appear in court for arraignment March 12.
