Grand jury clears Summer Adkins of murder

PRESTONSBURG, Ky. — A Floyd County grand jury has determined that a Prestonsburg woman will not face criminal charges for shooting and killing her father.

Grand jurors returned a “no true bill” in the case on Wednesday, clearing Adkins of criminal responsibility.

Adkins, 22, was arrested on a charge of murder after her father, 62-year-old Jimmy Harvey, was shot to death June 9.

During a preliminary hearing June 16, police testified that Adkins surrendered when they arrived on the scene. They further said she admitted shooting her father, saying she had been sexually abused by him as a child and she had learned he was doing the same to her niece.

“After reviewing all the evidence, as well as hearing from every member of Mr. Harvey’s family who wished to testify, the grand jury has voted not to indict Summer Adkins,” the grand jury’s report says. “While the grand jury is sympathethic to the family of Mr. Harvey and does not condone people taking the law into their own hands, it is our belief that no jury would convict Ms. Adkins given the circumstances here.”

The grand jury’s decision ends all prosecution of Adkins.

Last month, Adkins was released from home incarceration and her district court case was dismissed. However, that was a procedural dismissal due to the fact that she had not been indicted within 60 days of her arrest. The grand jury continued to consider the case until reaching a decision not to indict her on Wednesday.
