PIKEVILLE, Ky. — A Pike County man’s federal fraud trial will move forward as planned, after a judge denied his request to dismiss the case.
Eugene Sisco III, 35, of Pikeville, was indicted in U.S. District Court last November on charges of wire fraud and health care fraud. He is accused of requiring Medicaid patients at his drug treatment centers to pay cash for services that were also billed to Medicaid.
Sisco’s attorney had filed a motion to dismiss the case, arguing that the indictment did not allege conduct that would meet the definition of the charges against him. But U.S. District Judge Robert Wier disagreed, saying the points raised by the defense are factual matters that should be left to a jury to sort through.
Sisco is set to go on trial November 1st.
