Teen to be prosecuted as adult for parking garage shooting

PIKEVILLE, Ky. — A Floyd County teen will be tried as an adult, following a shooting in Pikeville last October, when he was still days away from his 18th birthday.

Brandon Lee Poston, 18, of Allen, is charged with attempted murder, first-degree assault, two counts of first-degree wanton endangerment, and minor in possession of a handgun.

Pikeville Police responded to the downtown parking garage on Oct. 6, over reports of a shooting. There, they found one person had been shot in the leg and another person had been shot in the foot.

Following an investigation, police identified Poston as their suspect. Poston was arrested at his home and reportedly admitted to firing his gun in the parking garage.

Until now, Poston had been treated as a juvenile in the court system, because the shooting occurred 48 days before his 18th birthday. But he will now be tried as an adult, following his indictment by a grand jury.

If convicted, the attempted murder and assault charges carry potential sentences of 10-to-20 years, while the wanton endangerment charges carry potential sentences of 5-to-10 years. The gun charge is a misdemeanor.

An indictment warrant has been issued by the special judge overseeing the case.
