War veteran gets break with four-year sentence on federal drug charge

PIKEVILLE, Ky. — A Michigan man who was arrested after police pulled him over in Magoffin County and found nearly 2 lbs. of meth in his car has been sentenced to four years in prison.

Cortez Harris, 38, of Detroit, was arrested back in January and indicted on a federal charge of possession with the intent to distribute the following month. He pleaded guilty to the charge back in June.

Following a background check, sentencing guidelines called for a prison term of 70-to-87 months. But Harris asked for a downward departure from the guidelines.

As mitigating factors, he offered his decision to take responsibility for his actions, his lack of a criminal history, and his status as a war veteran who fought in the Battle of Mosul. He also told the court that he had been struggling financially because he had still not received his service-connected disability due to PTSD. He said those struggles prompted his mistaken decision to accept an offer to deliver the drugs to Eastern Kentucky for $1,000.

While prosecutors objected to the variance, the judge was apparently swayed and sentenced Harris to 48 months in prison. He currently remains in the Pike County Detention Center, awaiting transfer to the federal prison system.
