PIKEVILLE, Ky. — One of the two men arrested for a burglary that left the homeowner dead has now been charged with murder.

A Pike County grand jury charged Curtis “Boog” Jones, 39, of Rockhouse, with killing Timothy Justice, 60, of Elkhorn City, during the break-in on Dec. 18. Jones also faces charges of felon in possession of a firearm and tampering with physical evidence.

He is also charged, along with James Dewayne Phillips, 47, of Elkhorn City, with first-degree burglary for the break-in.

Phillips faces up to 20 years in prison if convicted on the burglary charge.

Murder is a capital offense, meaning Jones could face anywhere between 20 years and life in prison if convicted. The burglary charge could also enhance the murder charge to make Jones potentially eligible for the death penalty, but prosecutors have not yet said whether or not they will seek it.
