Kentucky State Police responded to Widow’s Branch, where the victim told troopers he had been riding a side-by-side when James Daugherty, 44, of Phelps, pulled up beside him. The victim said an argument broke out between his wife and a woman with Daugherty, prompting him to drive away.

Just after midnight, while stopped to use the restroom, the victim saw headlights approaching. His wife recognized the vehicle as Daugherty’s. Moments later, Daugherty allegedly fired two shots, hitting the victim in the foot.

Troopers located Daugherty around 2:30 a.m. He denied the shooting and claimed the victim had fired at him. However, police say he had a handgun, despite being a convicted felon.

In 2022, Daugherty pleaded guilty to assault and wanton endangerment, after pistol-whipping a woman and firing a gun inside the home, with the woman and a 14-year-old boy inside at the time. He received a five-year suspended sentence in that case.

Daugherty is now charged with first-degree assault and possession of a handgun by a convicted felon, as well as a probation violation.
